Introduction

This Privacy Policy describes how Up Marketing collects, uses, and shares your personal information when you use our diagnostic tool.

Information We Collect

We collect the following types of information:

  • Contact Information: Name, email address, company name, role, phone number (optional), and website (optional) that you provide when requesting your implementation plan.
  • Diagnostic Responses: Your answers to our diagnostic questions about your business systems and operations.
  • Business Context: Self-reported annual revenue, pain areas, help priorities, team size, software tools and spend, and any additional context you provide during the diagnostic.
  • Results and Scores: Your computed efficiency score, revenue leakage estimate, and identified opportunities (stored on our servers as you progress through the diagnostic).
  • Technical Data: Session identifiers (used to link your diagnostic progress), and IP address (used for rate limiting and security).

How We Use Your Information

We use the information we collect to:

  • Generate your diagnostic results and recommendations
  • Prepare and deliver your customized implementation plan
  • Use AI (OpenAI) to generate your implementation plan, verify results, and create personalized follow-up content
  • Contact you about your diagnostic results
  • Improve our diagnostic tool and services
  • Comply with legal obligations

Information Sharing

We do not sell your personal information. We may share your information with:

  • OpenAI: Your diagnostic responses, results, and contact information are processed by OpenAI to generate your customized implementation plan, verify scoring, and create follow-up content. OpenAI's use of data is governed by their privacy policy.
  • Service providers: We use Supabase for database and backend services and Netlify (or similar) for hosting. These providers process data necessary to operate our service.
  • Professional advisors such as lawyers and accountants
  • Law enforcement or regulatory bodies when required by law

Data Storage and Security

Your diagnostic progress is saved locally in your browser as you complete the assessment. In addition, when you select your industry and as you progress through the diagnostic (including when you view your results), we sync your responses, scores, and related data to our servers. This allows us to generate and store your implementation plan when you submit the contact form. We implement appropriate technical and organizational measures to protect your personal information.

Your Rights

Depending on your location, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information
  • Object to or restrict processing of your information
  • Request a copy of your information in a portable format

Cookies and Tracking

We use local storage in your browser to save your diagnostic progress. This allows you to leave and return without losing your answers.

We use cookies for A/B testing to improve our service. These cookies (e.g., ab_hero-cta, ab_results-cta) assign you to a variant of our experiments and store only experiment name, variant, and event timestamps—no personally identifiable information. They expire after 30 days.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date.
